Case History
R –v- M
The Defendant was charged with an offence rape. He pleaded not guilty and the case proceeded to trial. As a result of thorough preparation and investigative work on his behalf Kelly was able to provide sufficient evidence to the court at trial to undermine the prosecution case resulting in him being acquitted of the charge after less than 10 minutes deliberation by the jury.

R –v- W
Defendant was charged with an offence of Robbery to which he pleaded guilty. The defendant had numerous previous convictions for robbery offences and was at risk of receiving an Indeterminate sentence for Public Protection (IPP). This was something the defendant was extremely anxious to avoid. As result of expert mitigation presented on his behalf at the sentence hearing we succeeded in persuading the court not to impose an IPP and to impose a determinate sentence of imprisonment instead.

R –v- M
Defendant was charged with conspiracy to commit burglaries. Kelly was required to undertake a detailed analysis of cell site evidence and expert reports. Whilst the defendant ultimately pleaded guilty to the offence we were able to persuade the prosecution that there was insufficient evidence to link the defendant to a number of offences alleged to form part of the conspiracy. This, combined with reports obtained by Kelly to assist the court by way of mitigation, resulted in the defendant receiving a shorter sentence than would otherwise have been the case.

R –v- C
Defendant was charged with serious allegation of assault upon his partner alleged to have occurred in the presence of their child who was the main prosecution witness. The case clearly needed to be dealt with sensitively in the circumstances. A conviction would have had serious long-term implications for the defendant in both his professional and personal life. Kelly spent a great deal of time with the defendant in preparing the case fully for trial. The defendant was subsequently acquitted.
