Jonathan Mcilveen

Jonathan Mcilveen Jonathan was recruited by Cobleys Solicitors Ltd as a partner in November 2007 specifically to work with Eric Williams in the Business Litigation Unit.

Prior to this Jonathan was a partner for another local firm dealing specifically with Serious Fraud Cases. He has experience of all types of criminal cases ranging from appearing in the Magistrates Court to dealing with the most serious of Crown Court Cases.

Over several years Jonathan’s focus has been concentrated on dealing with the most high profile and complicated Crown Court matters to which he has found that his attention to detail and meticulous preparation has led to numerous successful acquittals.

Not only has Jonathan dealt with the preparation of the above cases but now also enjoys appearing at the Crown Court as a Solicitor Advocate.

Over the last 5 years Jonathan has become involved in dealing with “gangmasters” who have been threatened with the revocation of their GLA licences for alleged breaches of the Licensing Standards (2012). This relatively new and niche area of work deals with those individuals and companies who have obtained a GLA Licence, permitting them to act as a “gangmasters” as governed by the Gangmasters Licensing Authority.

 Jonathan has found with many of these cases, early intervention and liaison with the GLA can be crucial to retaining a  licence. Of course, this is not always possible and in circumstances where a resolution cannot be found the matter must be contested at an Oral Hearing.  

Not only does Jonathan have experience of these appeals but he has also advised several recruitment companies in relation to issues of compliance in respect of the Licensing Standards, either prior to their first application or before routine compliance inspections.

Such is his expertise in this area of law, Jonathan regularly lectures on this subject to individual licence holders, recruitment companies and umbrella companies.

In the last three years to October 2012 Jonathan’s practice has included:

  • Acting for defendants in cases of MTIC fraud, mortgage fraud, conspiracy to cheat the public revenue, conspiracy to supply drugs and murder.
  • Successfully defending  a solicitor charged with a multi million pound mortgage fraud
  • Arguing against a multi-million pound confiscation order sought under the Proceeds of Crime Act 2002.
  • Attending interviews under caution for GLA licence holders suspected of criminal offences.
  • Acting for GLA licence holders in successful appeals against revocation of their licence.
  • Judicial Review of HMRC in matters concerning national minimum wage legislation.
