Paperwork in conveyancing, when selling a house, includes a form called the Law Society Property Information Form, or a "TA6". This form ensures that the Solicitor asks the Seller whether the property is currently or has ever been affected by Japanese Knotweed.

If knotweed is identified then before the mortgage company will lend the purchaser the  money they usually ask for evidence that there is a Treatment or Knotweed Management Plan (KMP) in place.

If you have bought a house that's affected by Japanese knotweed, and the seller has failed to identify this on the TA6 Form then you may be  able to bring about a claim against the seller as they have misrepresented the facts.
Our experts will help establish a timeline as to the growth of the Knotweed and thus determine how long it was on the property prior to the purchase. They can also identify if it has been treated previously as this can be evidence that the seller was aware of the issue.

When a property is affected by Japanese knotweed, whether it is in the boundary or within close proximity it loses considerable value and your home may be worth less than you paid for it. This is called diminution of value.
Here at Cobleys we will investigate your case and advise the best approach to try and claim for the treatments costs of getting rid of your Knotweed and get you as much compensation as we can.
